These Terms of Use ("Terms") govern your access to and use of kingfisherrealty.com and any related services (the "Service") provided by Kingfisher Realty LLC ("Kingfisher Realty," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use the Service. By using the Service you represent that you meet these requirements.
About the Service
Kingfisher Realty is a South Carolina licensed real estate brokerage. The Service provides general information about properties, market trends, and our brokerage. The Service does not constitute a real estate, legal, tax, or financial advisory relationship. Any agency or transactional relationship requires a separate written agreement.
Use of the Service
You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You agree not to:
- Use the Service to violate any law, regulation, or third-party right
- Scrape, harvest, or otherwise extract data from the Service in bulk
- Interfere with or disrupt the Service or its infrastructure
- Use any automated system (bot, crawler, etc.) other than standard search engine indexing
- Attempt to gain unauthorized access to any portion of the Service or related systems
- Submit false, misleading, or fraudulent information
Property and Listing Information
Property listings, valuations, market data, and similar information available through the Service are provided for general informational purposes and are believed to be reliable but are not guaranteed. Property data may come from third-party sources (including MLS feeds, public records, and third-party data providers) and may not be current, complete, or accurate. Independent verification is recommended before relying on any property information.
Home Valuation Requests
Any home valuation, comparable market analysis, or estimate provided through the Service is an opinion of value for informational purposes only. It is not an appraisal and should not be relied upon as one. A licensed appraiser must be engaged for any formal appraisal.
Third-Party Links and Services
The Service may link to third-party websites or integrate third-party services (for example, MLS search, mapping, mortgage calculators, or accounting integrations). We are not responsible for the content, accuracy, or practices of those third parties. Your use of any third-party site or service is at your own risk and subject to that provider's terms.
Intellectual Property
All content on the Service, including text, graphics, logos, images, and software, is owned by Kingfisher Realty or its licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works from any content on the Service without our prior written permission, except for reasonable personal, non-commercial use.
No Warranty
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Kingfisher Realty disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
Limitation of Liability
To the maximum extent permitted by law, Kingfisher Realty and its affiliates, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our aggregate liability for any claim arising from your use of the Service will not exceed one hundred dollars ($100).
Indemnification
You agree to indemnify and hold harmless Kingfisher Realty and its affiliates, members, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Service, or your violation of any law or third-party right.
Governing Law and Venue
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Lexington or Richland County, South Carolina, and you consent to the personal jurisdiction of those courts.
Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be effective when posted. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms.
